ABSTRACT : The deliberation in the following paper has the intentional meaning of sparkling or raising a doubt about the sustainability of the phenomenon known as empathy (from a cognitive point of view), highlighting the primary question in relation to its nature. The main focus will be centered (hopefully!) towards an approach that will take into account thoughts about the issue and the moral responsibility, because there is a belief that understanding the phenomenon cannot be excluded from the issue of freedom1 . This belief, though, will be object, in another context, of further analysis, because, at this moment, it is primarily important to reflect either of the nature of free will and the cognitive empathy.
